Customer SCCs and IDTA from November 2023

In June 2021, the European Commission adopted updated Standard Contractual Clauses (SCCs) to reflect the requirements of the General Data Protection Regulation (“GDPR”) and the Court of Justice of the European Union’s judgment in Schrems II. Except where an adequacy decision applies, these SCCs apply to international transfers of personal data subject to GDPR under contracts entered into on or after September 27, 2021.

 

On 21 March 2022, the UK Parliament approved the UK International Data Transfer Agreement (IDTA) for use in connection with international transfers of personal data subject to UK data protection law. The UK IDTA replaced the legacy EU SCCs previously relied upon for UK transfers and reflects the UK’s post‑Brexit data transfer regime, including the implications of Schrems II. Except where an adequacy decision applies, the SCCs and UK IDTA available on this page apply to international transfers of personal data subject to UK GDPR under contracts entered into on or after September 21, 2022.

 

Together, these instruments form LSEG’s customer international transfer framework introduced from December 2022.

 

On 30 November 2023, in light of regulatory developments in Mainland China, LSEG expanded this framework to include China‑specific terms and a template Standard Contract for Outbound Transfer of Personal Information in the form prescribed by the Cyberspace Administration of China. For this purpose, “Mainland China” excludes Hong Kong SAR, Macau SAR, and Taiwan.

 

In May 2026, LSEG further expanded this framework to include the Brazilian National Data Protection Authority (ANPD) Standard Contractual Clauses, issued under Resolution CD/ANPD No. 19/2024. These clauses apply automatically, where required, to applicable international transfers of personal data originating from Brazil.
